Merck loses latest round in federal court
A federal jury in New Orleans has held Merck negligent in the latest Vioxx case. The jury concluded that the giant drug company "knowingly misrepresented or failed to disclose a material fact" to the physician of a former FBI agent. Merck was ordered to pay $50 million and the jury is scheduled to consider punitive damages later. The verdict marks Merck's fourth loss, compared to five court victories. But there are thousands of more lawsuits to fight and Merck insists that it will continue to take them on one case at a time. Merck has set aside nothing for liability in these cases and a billion dollars for its defense fund.
